Unemployment Benefits - FAQ

When will I receive my unemployment benefit?

  • First payment :
    Your first unemployment benefit will generally be paid within 10 days after the approval decision is issued.
  • Subsequent payments :
    Thereafter, your full unemployment benefit will be paid on the fifth working day of the following month (M+1).
    Example: for the month of December, the payment will be made on the fifth working day of January.
  • Bank processing time :
    Depending on your bank, it may take 1 to 2 days before the amount appears in your account.

I occasionally engage in paid employment, what are my obligations?

You are required to declare all income from a regular or casual paid work activity. Such income may, under certain conditions, be compatible with the unemployment benefit.

I was dismissed for serious misconduct, am I entitled to compensation?

In principle not but you can apply for payment of unemployment benefit as part of a lawsuit for unfair dismissal.

 

I have to go abroad for a few weeks, what should I do?

Notify your counselor of reference about any change regarding your situation (like staying abroad, training, partial employment...) during your period of unemployment.

Attention: your allowances will be suspended during this period and you will no longer benefit from health insurance. Before you leave, do not forget to opt for a private insurance in case you are not covered otherwise!

  The maximum duration allowed is 25 days per year. Following, your absence, you must report on the 1st working day to your referring consultant following the end of the period of unavailability.

Is the 13th month included in the allowances?

No, the 13th month is not included in the unemployment benefit.

I am a cross-border commuter and unemployed. Am I entitled to health insurance?

You receive benefits in kind and in cash according to the legislation of your country of residence. Check with the authority in charge by your country.

Am I entitled to benefits if I am ill during my notice period?

Because you will continue to receive sickness allowance, you will not be entitled to unemployment benefits.

On the other hand, if you get sick, during your unemployment, you will continue to receive your benefits if not taken care of by another social security authority.

I am a resident. Is my leasing car taken into account when calculating my allowance?

Yes indeed, if: 

  • this car is put at your disposal for professional and private purposes,
  • this car is part of your employment contract;
  • your social contributions, which are paid to the Joint Social Security Center (Centre commun de la Sécurité sociale - CCSS) on the amount representing the provision of this car.

Can I dispute the refusal / withdrawal of my allowance?

You may apply by registered letter to the Special Reconsideration Commission (Commission spéciale de réexamen - CSR) for reconsideration within 40 days as of the notification of the decision by the Director of ADEM.

If you disagree with the decision by the CSR, you can complain by a simple written request to be filed out in duplicate at the head office of the Council of Social Security (CASS) within 40 days following the notification of the contested decision.

If the decision of the CASS is challenged, the appeal may be lodged by application in duplicate to the Higher Social Security Council (Conseil supérieur de la Sécurité sociale - CSSS) within 40 days following the date of notification of the decision by the CASS. The decision of the CSSS may be challenged by appeal before the Court of Cassation.

The application with the CASS and / or the CSSS must summarily state the arguments on which the appeal is based.
