An applicant for international protection (DPI) who has been awaiting a decision from the General Department of Immigration for at least six months may apply for a temporary work authorisation (AOT) to engage in salaried employment in Luxembourg. The DPI and the employer wishing to hire them are jointly responsible for submitting the AOT application. ADEM is involved in this process to verify whether the employer has duly declared the vacant position intended for the DPI. The final decision to grant or refuse the temporary work authorisation is made by the General Department of Immigration.
The AOT application must include the following documents:
- The AOT application form
- A copy of the certificate confirming the submission of the international protection application
- If applicable, a copy of certificates demonstrating the employee's professional qualifications
- The employee's curriculum vitae (CV)
- An explanatory letter from the employer justifying the hiring decision
- A copy of the employment contract
- A certificate of affiliation (if renewing the AOT)
The AOT is valid for a maximum of 6 months, although it can be renewed, and applies to only one profession and one employer. The granting of an AOT does not impact the international protection application process, does not confer the right to a residence permit, and does not entitle the applicant to unemployment benefits.
