Recruitment of a beneficiary of a postponement or suspension of removal
A person benefiting from a postponement of removal (report à l'éloignement) or a suspension of removal (sursis à l'éloignement) may submit an application for a temporary work permit (autorisation d'occupation temporaire – AOT) in order to take up salaried employment in Luxembourg. It is incumbent upon the person concerned, together with a company wishing to hire them, to submit this AOT application to ADEM. ADEM then verifies whether the employer has declared the vacant position intended to be filled by the person concerned. The temporary work permit is granted or refused by the Directorate General for Immigration.
The AOT application consists of the following documents:
- the AOT application form;
- a copy of the certificate of postponement or suspension of removal;
- where applicable, a copy of the certificates attesting the professional qualifications of the employee;
- a CV of the employee;
- a cover letter from the employer justifying the hiring of the employee;
- a copy of the employment contract;
- a social security affiliation certificate (in the event of renewal of the AOT).
The AOT, which has a maximum period of validity of 6 months (but is renewable), is valid for a single profession and a single employer only. The granting of an AOT has no bearing on the postponement or suspension of removal and confers no entitlement to a residence permit or to any unemployment benefits.
Important
When processing the AOT application, ADEM does not carry out a labour market test.
